History

The Council of National Security and Defense of Ukraine was established by the Presidential Decree in July 1992 as an advisory deliberative body in the body system of state executive power under the President of Ukraine. By this way it existed till 1994 until it obtained again according to the Presidential Decree functions of coordination organizational activity. Grant of coordination authorities and simultaneously undertaking measures on adequate information supply enabled the Council and its staff to act much more effectively, to broach serious subjects of the state. At the same time there have been corresponding restrictions as far as the status of the Council has been determined on the level of Presidential Decrees while its activity influenced on the activity of the President of Ukraine, Government, force structures etc., and required affirmation on the constitutional and legislative levels. Signing of a Constitutional agreement in 1995 between the Verkhovna Rada and the President of Ukraine was the first attempt adequately to determine the status of the Council of National Security and Defense and its position in the system of state bodies of Ukraine according to which functions of a Guarantor of National Security and Defense of Ukraine and a Head of the Council of National Security and Defense of Ukraine have been invested on the President of Ukraine. In the Constitution of Ukraine of 1996 this issue has been studied much more profoundly. Firstly, it establishes a new state body - the Council of National Security and Defense of Ukraine that inherited the functions of former Council of Defense and Council of National Security. Secondly, the Constitution determines the principle tasks of this body - coordination and control of the state bodies of executive power activity in the sphere of national security and defense. Thirdly, in the contents of the Constitution the principle basis of the CNSDU are directly determined and after all the Constitution contains a direct instruction on special law elaboration that would define functions and authorities of the Council. Thus, at the present moment the Council of National Security and Defense of Ukraine is a specialized state body with constitutional status which is an integral part of the presidential power and is supposed to ensure one of the most important constitutional functions of the President - state independence and national security of the state.
