Letter of intent between the Ministry of defence of the Kingdom of Sweden and the Ministry of defence of Ukraine concering the joint production of defence materiel in Sweden and Ukraine
The Ministry of Defence of the Kingdom of Sweden (the "Swedish Participant") and the Ministry of Defence of Ukraine (the "Ukrainian Participant"), hereinafter referred to collectively as the "Participants", acknowledge that the security of Ukraine is integral to the security of Sweden and the broader Europe. The Participants share the conviction that building resilient supply chains and mobilizing defence industry is crucial for the security of Ukraine, Sweden and the broader Europe.
The Participants, building on their excellent mutual relations and the steadfast Swedish support for Ukraine, declare their readiness to support joint defence-industrial production projects in Sweden and Ukraine for the benefit to security of Ukraine, Sweden and the broader Europe.
I. The Participants declare their willingness to establish deeper cooperation in defence production by supporting the co-production of defence materiel on the territory of Sweden and Ukraine.
II. The Participants intend that defence materiel co-produced in Sweden will be exported back to Ukraine to help the Ukrainian Participant repel the armed aggression of the Russian Federation and deter future aggression. Any export of defence materiel produced in Sweden is subject to separate and independent national approval processes, as well as applicable national and international law. Defence materiel co-produced in Sweden may also be purchased by the Swedish defence agency to the benefit of Sweden.
III. The Signatories intend to provide support, to facilitate this cooperation, subject to their respective national approval processes and in accordance with their respective national laws and international commitments.
IV. The Ukrainian Participant intends to facilitate the sharing of technology for the setup and operation of Ukrainian origin defence materiel production facilities in Sweden for the benefit of the security of Ukraine, Sweden and the broader Europe.
V. This Letter of Intent does not constitute a legally binding commitment, neither under international nor national law, between the Participants. This Letter of Intent does not create any authority to perform any work, award any contract, transfer funds, or otherwise obligate a Participant in any way to make or provide any financial or non-financial contribution to the other Participant for any purpose. Any legal, financial or any other type of commitment is subject to the establishment of separate arrangements, subject to the Participants' or their government's national approval procedures.
VI. Any differences regarding the interpretation or implementation of this Letter of Intent will be resolved exclusively between the Participants.
VII. This Letter will be signed in two copies in the English language and will come into effect upon the date of the last signature.
