MOTION HEARINGS CONDUCTED FOR TWO SOLDIERS
CAMP VICTORY SOUTH, BAGHDAD - Motion hearings were held today in the cases of sergeant Javal Davis and specialist Charles Graner, two military police soldiers accused of abusing detainees at Abu Ghraib.
Specialist Graner, through his defense attorneys, requested a psychologist be provided as a witness at the government's expense. The military judge found that the defense failed to show how the witness was relevant. The government has agreed to provide another psychologist.
The defense attorneys also requested that the court martial proceedings be abated, or put on hold, until the government gives eight witnesses testimonial immunity.
The military judge denied this motion finding that the defense failed to support their request. Another motions hearing for Specialist Graner is scheduled for December 3. The trial is scheduled for January 7.
Sergeant Davis, through his attorneys, requested several expert witnesses be provided at government expense. The military judge denied some of the witnesses, but deferred ruling on the other expert witnesses until the parties provide additional information. The defense attorneys also requested that several witnesses be granted testimonial immunity. The military Judge denied the motion.
The next motion hearing for Sergeant Davis is scheduled for December 4. The trial is tentatively set for February 1.
