
Statement by High Representative Kaja Kallas on the Joint Comprehensive Plan of Action (JCPoA)

In my role as Coordinator of the Joint Commission of the JCPoA, I was informed by letter today that the Foreign Ministers of France, Germany and the United Kingdom - the E3 - have notified the United Nations Security Council that they believe Iran is in significant non-performance of its commitments under the JCPoA, thereby invoking the process known as the "snapback" mechanism in accordance with paragraph 11 of the UNSCR 2231.
The E3 recall that they had registered their concerns Iran was not meeting its commitments under the JCPoA, and had referred this matter to the Joint Commission, under the JCPoA Dispute Resolution Mechanism (DRM), as acknowledged in the statement by the Coordinator, of 14 January 2020. They state that, since then, the JCPOA Joint Commission has reviewed this issue regularly and extensively, and describe good faith efforts by the E3 to resolve the issue, including through negotiations with the JCPoA participants and the United States, as well as further efforts.
The Coordinator of the JCPOA Joint Commission noted in the statement of 6 October 2023 that following consultations with all JCPOA participants, the issue remained unresolved given diverging views expressed.
The E3 also refer to meetings with Iran over the past year, and that they most recently 'offered to agree to an extension of the provisions of UNSCR 2231, should Iran take specific steps to address their most immediate concerns'. The E3 also reiterate their continuing commitment to a diplomatic solution to the Iranian nuclear issue.
The issue is now in the remit of the UN Security Council. I remain resolved to do everything possible to facilitate further diplomacy and a negotiated solution to the Iranian nuclear issue in my role as Coordinator of the Joint Commission of the JCPoA. I call on all parties concerned to urgently undertake the necessary efforts in this regard.
