HKSAR moves to ban 2 secessionist groups to safeguard Constitutional order

After the Hong Kong Special Administrative Region (HKSAR) government announced on Monday that the Secretary for Security is considering to make orders under the Safeguarding National Security Ordinance to prohibit the operation of two secessionist organizations - the "Hong Kong Parliament" and the "Hong Kong Democratic Independence Union," Secretary for Security Chris Tang said on Tuesday that these organizations attempted to split the country and subvert state power, thereby undermining the fundamental constitutional order of the nation.

With the Legislative Council election day approaching, authorities will enforce the law strictly against any acts that disrupt the electoral process, Tang said, according to local media reports.

The Security Bureau of the HKSAR said that the two organizations in question aim to subvert state power with the objectives including promoting "self-determination," making a "Hong Kong Constitution" and overthrowing or undermining the basic system or authority of the People's Republic of China or the authority of the HKSAR.

Acts specified as offences in sections 62 to 65 of the Safeguarding National Security Ordinance include acting as an officer-bearer or a member of a prohibited organisation; participating in any activity or meeting of a prohibited organisation; inciting any other person to become a member of a prohibited organisation; and giving aid of any kind to or procuring any subscription or aid for a prohibited organisation. Those who commit such offences are liable to a fine of $1,000,000 and imprisonment for 14 years, according to a statement on the HKSAR government's website.

Some 19 members of the "Hong Kong Parliament" had earlier left Hong Kong and gone into hiding, and have been placed on a wanted list as specified absconders. Another Hong Kong-based member was previously arrested, prosecuted and sentenced to 12 months in prison for allegedly publishing messages with seditious intent, Tang told media on Tuesday.

As for the "Hong Kong Democratic Independence Union," four members of the organization have been arrested and charged with conspiracy to commit secession, and are currently awaiting for court proceedings. He also revealed that one active member of the alliance is suspected of calling on the public to cast blank ballots or not to vote in the upcoming election, and has been placed on a wanted list by the under the Elections (Corrupt and Illegal Conduct) Ordinance.

Relevant departments have issued written notices to both organizations, and the two groups may make representations within seven days, Tang said.

These two organizations openly advocate "Hong Kong independence" and "self-determination," and attempt to draft a "Hong Kong Constitution." Such actions not only seriously violate China's Constitution and the Basic Law (of the HKSAR), but also directly challenge the bottom line of the "One Country, Two Systems" principle, said Willy Fu, a law professor who is also the director of the Chinese Association of Hong Kong & Macao Studies.

"Their activities are aimed at splitting the country and subverting state power, posing a grave threat to the security of both Hong Kong and the nation. National security is the cornerstone of Hong Kong's prosperity and stability, and any acts that undermine national sovereignty, security or development interests must be firmly combated in accordance with the law," Fu told the Global Times on Tuesday.

The 2025 LegCo General Election will be held on December 7, according to the HKSAR government.
