US suspension of Affiliates Rule marks key step in implementing China-US Kuala Lumpur consensus; both sides to discuss arrangement after one-year pause: MOFCOM

In response to a question about the US Commerce Department's Bureau of Industry and Security publishing a notice in the Federal Register on Monday local time announcing a one-year suspension of its Affiliates Rule, and whether the suspension may be extended after one year, a Ministry of Commerce spokesperson said China has taken note of the announcement.

The spokesperson said the US has stated that from November 10, 2025 to November 9, 2026, it will suspend the Affiliates Rule, meaning that during this period, affiliated companies in which entities already placed on the US export control Entity List and other sanctions lists hold more than a 50-percent stake will not be subjected to the same additional export control measures under this rule.

This is an important step by the US in implementing the economic and trade consensus reached during the China-US Kuala Lumpur consultations. As for arrangements after the one-year suspension, the two sides will continue discussions, the spokesperson said.

China is willing to work with the US, on the basis of mutual respect and equal consultation, to strengthen dialogue and communication, properly manage differences, and jointly create favorable conditions for promoting mutually beneficial cooperation between the two countries' enterprises and for ensuring the security and stability of global industrial and supply chains, the spokesperson said.
