Three More Witnesses Testify in Second Session of Alban Murder Hearing

-- The second session of a premeditated murder hearing for a Task Force Baghdad Soldier was held Oct. 22 at the Camp Liberty Court House.

The Article 32 investigating officer heard three new witnesses, including one Criminal Investigation Division special agent, and two Soldiers who witnessed the alleged incident.

The hearing allows the IO to gather information and make a recommendation to the convening authority on the case.

The IO has yet to make a recommendation for Staff Sgt. Cardenas J. Alban of Company C, 1st Battalion, 42nd Infantry Regiment to be tried for one specification of premeditated murder and one specification of conspiracy to commit murder.

Alban and one other Soldier are accused of conspiring and committing the murder of an Iraqi civilian in the Al Thawra District.

The IO will hear from an Iraqi who witnessed the alleged incident, as well as another CID agent at the next session of the hearing.

The Article 32 hearing will resume Oct. 25 at the Camp Liberty Court House.

Another Article 32 hearing to investigate Staff Sgt. Johnny M. Horne, Jr., from the same company as Alban, will be held Oct. 26 at the Camp Liberty Court House, according to Horne's defense council.

Horne is accused of one specification of premeditated murder and one specification of conspiracy to commit murder. Horne was allegedly part of the same incident, according to the prosecuting officer's statement at Alban's hearing.

All the incidents are under investigation. All accused Soldiers have yet to be tried in this matter. The charges are merely accusations. Alban and Horne are presumed innocent until and unless proven guilty.
