Investigation Directorate

The Investigation Directorate was established by an order of the SBU's chief on November 29, 1991, on the basis of the Investigation Division of the former Ukrainian KGB (State Security Committee). The existence of an investigation department within the SBU's structure is contemplated also by Article 10 of the Law of Ukraine "On the Security Service of Ukraine".

The Investigation Directorate and investigative divisions at regional SBU offices are independent elements within the Security Service of Ukraine, constituting its preliminary investigation system.

SBU's investigation elements conduct prejudicial inquiry on criminal cases relating to especially grave offenses or other crimes against the state, and illegal actions in the domain of administration and economy, posing a danger to the society and directly threatening Ukraine's vital interests. Under Article 112 of the Criminal and Procedural Code of Ukraine, such actions constitute 16 corpora delicti, responsibility for which is contemplated in Parts 1 and 2 of Chapter I (Crimes Against the State) and Chapter XI (Military Crimes), as well as 14 corpora delicti, which are classified as crimes of so called "optional" investigation competence and responsibility for which is contemplated in Chapter I (Crimes Against the State), and Chapter II (Crimes against Public and Collective Property), and Chapter VII (Official Crimes) of the Special Part of the Criminal Code of Ukraine.

The key tasks of SBU's preliminary investigation elements are as follows:

  • all-inclusive, full-fledged, and objective inquiry into circumstances of a case under strict observance of laws in effect to provide for making a motivated and lawful judgment by each criminal case;
  • implementation of corresponding measures within the competence contemplated by law to preclude violation of citizens' rights and society interests;
  • ensuring payment of compensation to physical persons and legal entities for losses that they suffered from crimes;
  • identification of reasons and conditions that assist in the commission of crimes, as well as taking the relevant measures to stem them; and
  • legal rehabilitation of the honor, dignity, and rights of citizens who have suffered due to an illegal apprehension, arrest, or being criminally charged.

A preliminary investigator of the Security Service of Ukraine is an official who has been authorized by the state to investigate criminal cases that are included in his or her competence by law.

In investigating criminal cases, the preliminary investigators of the SBU cooperate with its operative divisions with an objective to uncover crimes and identify individuals who have committed them and are hiding from prosecution.

Preliminary investigator powers are determined by Ukraine's criminal and procedural legislation. In exercising these powers, the preliminary investigator is able to make independent decisions on the course of inquiry and how to carry out the investigative efforts, as he or she is subordinate only to the Law.
