A suspected Taliban member has been granted permission to stay in Britain after a judge ruled that he might face danger if he was deported to Afghanistan.

The ruling, which has been described by the British media as a new human rights scandal, was issued last week by the president of the Upper Tier Asylum and Immigration Tribunal, Sir Nicholas Blake QC.

Suspected Taliban member Abdul Martin Shizad had his asylum request rejected last April and was ordered to leave the UK, local media reported.

However, he launched a legal challenge to the decision on human rights grounds, arguing he would face arrest and torture if sent back, according to reports.

Judge Nicholas Blake QC said that “Shizad had a well-founded fear of persecution”.

But, a Home Office spokesman said the government was “extremely disappointed”.

“We did not believe that this individual needed or deserved refuge in this country”, added the spokesman.
